Please read these Terms of Service ("Terms") carefully before booking an appointment or engaging our services. By booking a technician, signing a service sheet, or engaging Node Support Solutions ("we", "us", "our") via on-site visit, remote assistance, or digital channels, you ("the Client") agree to be bound by these Terms.
1.1 Our services come with guarantees that cannot be excluded under the Australian Consumer Law (ACL). For major failures with the service, you are entitled:
to cancel your service contract with us; and
to a refund for the unused portion, or to compensation for its reduced value.
1.2 You are also entitled to choose a refund or replacement for major failures with goods. If a failure with the goods or a service does not amount to a major failure, you are entitled to have the failure remedied in a reasonable time. If this is not done you are entitled to a refund for the goods and to cancel the contract for the service and obtain a refund of any unused portion. You are also entitled to be compensated for any other reasonably foreseeable loss or damage from a failure in the goods or service.
1.3 Nothing in these Terms excludes, restricts, or modifies any guarantee, right, remedy, or liability implied or imposed by the ACL that cannot lawfully be excluded.
2.1 Node Support Solutions delivers on-site and remote IT support, diagnostics, computer repairs, virus removal, hardware upgrades, data recovery, network/Wi-Fi troubleshooting, and smart home system integration.
2.2 Same-Day Service: Same-day service bookings are subject to technician availability and are guaranteed only when explicitly confirmed before 10:00 AM on business days. Emergency or after-hours surcharges apply outside standard operational hours.
2.3 Cancellation & No-Show Fees: If you cancel a booked on-site appointment less than two (2) hours prior to the scheduled window, or if our technician arrives and is unable to gain access to the premises within fifteen (15) minutes of arrival, we reserve the right to charge a fixed No-Show Fee equivalent to one (1) hour of standard labor.
3.1 Billing Mechanics: Services are billed in transparent half-hour (30-minute) increments after the initial minimum charge of one (1) hour, unless a flat, fixed-price quote has been mutually agreed upon in writing.
3.2 Diagnostic Fees: If an accurate quote requires physical disassembly or intensive diagnostic utility runs, an inspection fee will be charged regardless of whether you proceed with the recommended repair.
3.3 Payment Timing: Payment must be finalized immediately upon completion of the service session. We accept major credit cards and direct bank transfers. We reserve the right to retain custody of any repaired physical hardware under a general common law worker's lien until full payment is received.
4.1 Our No-Fix, No-Fee Guarantee applies strictly if our technician lacks the professional technical skill or diagnostic tools to isolate or fix your specific issue. In this event, the service fee is completely waived.
4.2 Exclusions to the Guarantee: The No-Fix, No-Fee guarantee does not apply if:
The technician diagnoses the exact fault (e.g., a physically burnt-out motherboard or dead SSD) and outlines a resolution path, but you choose not to proceed with the purchase of required replacement parts.
The technician advises that the hardware is obsolete or unrepairable, and recommends a data extraction and system replacement path instead.
5.1 Inherent Risk: IT diagnostic procedures, software updates, virus cleanups, and hardware manipulation carry an inherent risk of data corruption, operating system failure, or total data loss.
5.2 Mandatory Backup: The Client bears absolute and sole responsibility for executing a comprehensive backup of all files, documents, software licenses, and databases prior to the arrival of the technician or commencement of remote access.
5.3 Data Loss Indemnity: To the maximum extent permitted by law, Node Support Solutions will not be held liable for any data loss, file corruption, software licensing issues, or configuration losses occurring during the provision of our technical services.
6.1 Pre-existing Imperfections: We are not liable for the degradation of aged components (e.g., brittle plastic clips, worn internal ribbon cables, or failing internal power supplies) that fracture or fail during routine, standard opening and repair practices.
6.2 Unclaimed Property: If physical hardware is left in our possession for repair or storage, and is not collected within ninety (90) days from our formal notice of completion or diagnosis, it will be treated as abandoned goods and handled in compliance with the Unclaimed Goods Act 1987 (SA) or corresponding state legislation.
7.1 Subject to Clause 1 (Australian Consumer Law), our liability for any breach of a contractual term, condition, or statutory guarantee is strictly limited, at our absolute discretion, to:
The re-supply of the IT support services; or
The payment of the direct, verified cost of having the services supplied again.
7.2 Under no structural circumstances shall Node Support Solutions be liable for indirect, special, punitive, or consequential damages, including but not limited to commercial downtime, business interruption, loss of data, loss of revenue, or loss of business opportunity suffered by the Client or any third party.
